JOB SUMMARY
This position is appointed to ensure effective internal control and compliance of the bank with the applicable laws and regulations issued by NBC and other regulators.
DUTY & RESPONSIBILITY
The Head of Internal Control department shall oversee 2 units: Regulatory Compliance Unit and Compliance Oversight and Reporting Unit.
1. Regulatory Compliance Unit
- Update Management and related stakeholders of the changes or adoption of laws and regulations applicable to banks and financial institutions.
- Review bank policies and guidelines and provide recommendation, ensuring compliance with applicable laws and regulations.
- Provide advice to relevant departments on bank's products and services.
- Draft, review and update, Internal Control Policy, Regulatory Compliance Policy, Procedure Manual, and guidelines.
- Consolidate and keep up to date Regulatory Compliance Checklist.
- Perform and consolidate Regulatory Risk Self-Assessment on and from relevant departments/divisions.
- Perform annual compliance testing to ensure bank compliance with NBC and other applicable laws and regulations.
- Ensure the implementation of NBC's recommendation from on-site/off-site inspection.
- Prepare Annual Internal Control Report.
- Create guidelines and policies on FATA (Foreign Account Tax Compliance Act) requirements, and assure its compliance.
- Participate in the establishment of FATCA Reporting System and handling process of International Data Transfer to IRS or Cambodian Government.
- Support in liaison with regulator and other government authorities and oversee regulatory report submission (FATCA, Internal Control, and other reports).
2. Compliance Oversight and Reporting Unit
- Prepare annual compliance oversight project plan.
- Prepare compliance oversight program in accordance with the approved framework and scope of review.
- Conduct branch on-site/off-site oversight review and assessment on compliance of the AML/CFT and internal policies implementation at branches and related departments/divisions.
- Review data sample selection by adopting risk-based approach.
- Identify BCO's AML/CFT implementation gap and training needs.
- Provide recommendation for improvement of AML/CFT and internal policies compliance implementation standard at branches and relate departments/divisions.
- Prepare the oversight review findings report and submit to Head of Compliance Division, Prepare summary of consolidated oversight finding report for ERCC and BCC,
- Prepare and consolidate monthly, quarterly and ad-hoc reports for Management, ERCC, BCC, and Board meetings.
- Perform other tasks as assigned by Head of Compliance Division and Chief Risk Office.
QUALIFICATION
- Bachelor's degree in Law, Finance and Banking, or equivalent in related fields;
- At least 4-year experience in legal compliance, audit, and risk is highly desired Sound knowledge of banking and other related laws, compliance, internal control, anti-money laundering etc.
- Ability to work independently and as a team in an effective and efficient manner
- Attention to details and able to work under pressure and possess good time management skill
- High personal quality of integrity, credibility, and strong work ethic and moral standard.
- Good communication and interpersonal skills
- Good command of speaking and written in English
- Good Computer literacy, especially Excel.
